Terms of Service

1. General Provisions

These Terms govern the use of Joyophone, a service for creating personalized songs using artificial intelligence tools. The service provider is Lasto Marcin Stola, NIP: 5213448945, Okrąg 3a/13, 00-415 Warszawa.

You can contact the provider at hello@joyophone.com. Please read these Terms and the Privacy Policy before using the service.

2. Account and Technical Requirements

• An account is required to create and save songs and to make purchases.
• You are responsible for the accuracy of your account details, the security of your account, and all activity performed through it.
• You need internet access, a current web browser, and a device capable of playing audio.
• The service is intended for adults. Minors may use it only with the consent and supervision of a parent or legal guardian.
• You may request account closure anytime by contacting the provider. Data required by law or needed to settle existing agreements may be retained.

3. Creating Songs

You can provide names, a theme, age range, style, mood, language, and your own description or lyrics. The service uses these choices to create lyrics, music, vocals, cover art, and supporting materials.

AI-generated content may contain errors or may not meet every expectation. An adult should review each song before sharing it with a child.

4. Content Rules

• Only submit content you have the right to use and that does not infringe on another person's rights.
• Do not submit unlawful, abusive, discriminatory, dangerous, privacy-invasive, or child-inappropriate content.
• Limit child information to what is genuinely needed for personalization. Do not submit surnames, addresses, schools, health information, or contact details.
• The provider may refuse to generate or remove content that violates these Terms or applicable law.

5. Payments and Song Tokens

Monthly Joy is a recurring subscription at $39 or £39 per month. Each paid month adds 5 song credits, 1 five-minute audio story credit, and 1 illustrated ebook credit. Credits can be used for different children on the same account. Unused credits roll over and remain available after cancellation. Cancel through the account billing portal before the next renewal; cancellation takes effect at the end of the current billing period.

The service may offer one-time packs of song tokens. The price, currency, number of tokens, and pack details are shown before purchase. Payments are processed by the payment provider available for your market.

A token is used when generation starts. If delivery fails due to a technical error within the service, the token may be automatically returned. Tokens are not money and cannot be transferred between accounts.

Purchased song tokens do not expire. The full price and available payment methods are shown before placing an order.

6. Digital Delivery

Joyophone provides digital services and content only. There are no physical shipments or delivery charges.

Purchased tokens are normally added to your account shortly after payment confirmation and no later than 24 hours after successful payment.

A finished song is usually available within minutes and no later than 24 hours after generation starts, unless a different timeframe is specified before ordering.

If an outage or third-party delay prevents delivery, the provider will give a revised estimate or return the song token.

7. Withdrawal Rights and Complaints

Consumers may withdraw from a distance contract within 14 days without giving a reason by sending a clear statement to hello@joyophone.com, subject to exceptions under applicable consumer law.

For digital content not supplied on a physical medium, the withdrawal right is lost only after performance begins with the consumer's explicit prior consent, acknowledgment of that loss, and the legally required confirmation.

Complaints can be sent to hello@joyophone.com. Please include a description, date, and information identifying your account or order. Consumer complaints are answered within 14 days.

Nothing in these Terms limits mandatory consumer rights that apply in your country of residence.

8. Rights to Content

You retain rights to content you submit and grant the provider a non-exclusive license to process it only as necessary to provide the service.

Rights in AI-generated results depend on applicable law and technology-provider terms. Unless a pack expressly states otherwise, finished songs are for personal, non-commercial use only.

9. Availability and Liability

The provider aims to keep the service available but may perform maintenance, security updates, and product changes.

The provider is not responsible for misuse of the service or content submitted by users. This does not limit liability or consumer rights that cannot be legally excluded.

10. Changes and Governing Law

These Terms may change due to changes in law, product features, payments, or technology. Registered users will receive advance notice of important changes.

Polish law applies to matters not covered by these Terms. This choice does not remove mandatory consumer protections under the law of your country of residence.
