Terms of Service

1. General provisions

These Terms govern the use of Joyophone, a service for creating personalized songs with artificial-intelligence tools. The service provider is Lasto Marcin Stola, NIP: 5213448945, Okrąg 3a/13, 00-415 Warszawa.

You can contact the provider at hello@joyophone.com. Please read these Terms and the Privacy Policy before using the service.

2. Account and technical requirements

• An account is required to create and save songs and make purchases.
• You are responsible for the accuracy of your account details, account security and activity performed through your account.
• You need internet access, a current web browser and a device capable of playing audio.
• The service is intended for adults. A minor may use it only with the consent and supervision of a parent or legal guardian.
• You may request account closure at any time by contacting the provider. Data required by law or needed to settle existing agreements may be retained.

3. Creating songs

You may provide names, a theme, age range, style, mood, language, your own description or lyrics. The service uses these choices to prepare lyrics, music, vocals, cover art and supporting materials.

AI-generated content may contain errors or may not meet every expectation. An adult should review each song before sharing it with a child.

4. Content rules

• Only submit content that you are entitled to use and that does not infringe another person's rights.
• Do not submit unlawful, abusive, discriminatory, dangerous, privacy-invasive or child-inappropriate content.
• Limit child information to what is genuinely needed for personalization. Do not submit a surname, address, school, health information or contact details.
• The provider may refuse to generate or may remove content that breaches these Terms or applicable law.

5. Payments and song tokens

The service may offer one-time packs of song tokens. The price, currency, number of tokens and pack scope are shown before purchase. Payments are processed by the payment provider available for your market.

A token is used when generation starts. If delivery fails because of a technical error in the service, the token may be returned automatically. Tokens are not money and cannot be transferred between accounts.

Purchased song tokens do not expire. The complete price and available payment methods are displayed before an order is placed.

6. Digital delivery

Joyophone supplies digital services and content only. There is no physical shipment or delivery charge.

Purchased tokens are normally added to the account shortly after payment confirmation and no later than 24 hours after successful payment.

A finished song is usually available within minutes and no later than 24 hours after generation begins, unless a different timeframe is shown before the order.

If an outage or third-party provider delay prevents delivery, the provider will give a revised estimate or return the song token.

7. Withdrawal rights and complaints

A consumer may withdraw from a distance contract within 14 days without giving a reason by sending a clear statement to hello@joyophone.com, subject to the exceptions provided by applicable consumer law.

For digital content not supplied on a tangible medium, the withdrawal right is lost only after performance begins with the consumer's express prior consent, acknowledgement of that loss and the legally required confirmation.

Complaints may be sent to hello@joyophone.com. Include a description, date and information that identifies the account or order. Consumer complaints are answered within 14 days.

Nothing in these Terms limits mandatory consumer rights that apply in the consumer's country of residence.

8. Rights to content

You retain rights in content you submit and grant the provider a non-exclusive permission to process it only as necessary to provide the service.

Rights in AI-generated results may depend on applicable law and technology-provider terms. Unless a pack expressly states otherwise, finished songs are provided for personal, non-commercial use.

9. Availability and liability

The provider aims to keep the service available but may introduce maintenance, security updates and product changes.

The provider is not responsible for misuse of the service or content submitted by a user. This does not limit liability or consumer rights that cannot legally be excluded.

10. Changes and governing law

These Terms may change because of changes in law, product functionality, payments or technology. Registered users will receive appropriate advance notice of material changes.

Polish law applies to matters not covered by these Terms. This choice does not deprive a consumer of mandatory protection under the law of their country of residence.
